Hobe Sound Criminal Defense Lawyer
Understand what you are being asked to sign.
A criminal notice may include a promise to appear and a separate plea section. Katz & Associates helps adults in Hobe Sound understand the document and defend state criminal charges. We can review what response is required and what work the defense may need.
Before signing a plea or sending a payment, ask what it would mean. If you have already acted, tell us what you signed or paid and when. You can also seek help after an arrest or while police are still investigating.

Separate the appearance promise from a plea
An officer's notice under Florida Rule 3.125 gives a place and time to answer an alleged offense. The rule permits notices for specified misdemeanors, violations and local ordinances, with exceptions. Some are issued by an arresting officer; others follow a booking officer's review. It is not a release option for every criminal matter.
Signing the release promise means agreeing to answer the notice as directed. It is separate from signing a guilty or no-contest plea and giving up rights. The rule's model form includes both a promise and a separate plea waiver. Read the whole document, including the back and any attachments, with counsel.
A plea waiver can let the court enter judgment and sentence without a trial. Before choosing that route, ask what rights you would give up and what result the plea could allow. Ask whether a payment also submits a plea or waiver, rather than looking only at the amount.
Some county-court prosecutions can proceed on a valid notice itself under Rule 3.140. A later document called an information is not always required. Have the notice reviewed rather than waiting for a different charging paper. If you signed and fail to respond, Rule 3.125 provides for an arrest warrant.
Test the accusation behind the form
The legal work starts with the alleged conduct. Katz & Associates handles DUI, drug offenses, assault, battery, domestic allegations, theft and fraud. The firm's Florida criminal defense services cover misdemeanors and felonies, not only cases begun by a notice.
If an allegation concerns messages from an account, counsel may need to establish who used it at the relevant time. The name on the account may leave that question unanswered. Keep the full exchange and tell your lawyer who else had access. Ask how records can be obtained lawfully rather than trying to enter someone else's account.
A defense review can also examine an officer's stop, search or questioning. A supported motion may seek to keep unlawfully obtained evidence or statements out of court. The rules for pretrial motions require legal grounds and supporting facts. Ask which issue, if any, supports that request.
Ask how the firm would investigate the disputed point and prepare to contest the charge. That can involve seeking records, examining witnesses and presenting admissible defense evidence at trial. Discuss the strengths and problems counsel sees before deciding whether an offer to resolve the case makes sense.
Discuss the accusation with Katz & AssociatesKeep the notice connected to the current court file
For a Martin County case, the Clerk's court records search provides dockets and non-confidential case documents. Have counsel compare the paper you received with what is now filed. Keep later notices too. The earliest copy may not show every charge or order that needs attention.
The Hobe Sound Clerk branch at 11730 SE Federal Highway accepts traffic payments. The Criminal Division is listed at 100 SE Ocean Boulevard, in Stuart's Constitutional Building. Use your actual hearing notice and current court instructions to confirm where and how to attend.
If your mailing address is wrong, use the case-address correction route in the Clerk's criminal questions. It directs people to the Criminal Division or its change-of-address form. The separate cash-bond address form concerns the bond depositor. Ask which record needs correction rather than assuming one change updates them all.
An arraignment addresses your answer to the charge. The Clerk describes a one-time request to move a misdemeanor arraignment by two weeks. The Clerk says further requests, other misdemeanor hearings and felony hearings require approval from the judge and assigned prosecutor. If you have counsel, consult your lawyer. Confirm a changed date before relying on the request. Hiring a lawyer also does not, by itself, excuse every appearance.
Show counsel a DUI suspension notice as well. Check the issue date on that notice. Florida's administrative-suspension law gives a driver 10 days after that date to ask for formal or informal review. The date on a criminal court notice does not set that review period. Ask about restricted-driving options and what your current license permits.
Questions about evidence and a signed response
Can a lawyer seek evidence beyond the notice?
Yes. A notice-to-appear prosecution can still involve criminal discovery, the process for exchanging case evidence. The notice procedure includes witness and physical-evidence lists. Counsel can assess what further material may be sought. Discovery has limits and can create duties for the defense too; it is not unrestricted access to every record.
What does a no-contest plea mean?
It is different from asking the state to prove the charge at trial through a not-guilty plea. With the court's consent, a no-contest plea can allow a sentence without a trial. It does not promise a clean record or no punishment. The plea rules govern the court's review. Ask counsel to explain the consequences before choosing it.
I already returned a signed plea form. What should I tell counsel?
Share the exact form, when you sent it and any court response. Counsel needs to check what the court accepted and any judgment or sentence on file. Timing and legal grounds affect any further step. Seek advice promptly; signing or mailing a form does not create a universal right to cancel a plea.
